Terms of Service

These Terms of Service ("Terms") govern your access to and use of the paksaf.com website, the AutoSense AI mobile applications, and related services (collectively, the "Service") operated by Mark Solutions ("we", "us"). By creating an account or using the Service you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract under the laws of your country. If you use the Service on behalf of a workshop, business, or fleet, you confirm that you have the authority to bind that entity.

2. Account

You are responsible for maintaining the confidentiality of your login and for all activity under your account. Notify us immediately at interact@paksaf.com if you suspect unauthorised use.

3. Nature of the Service — diagnostic guidance is informational

AutoSense AI uses speech recognition, computer vision, OBD-II telemetry, and large language models to generate diagnostic suggestions. These suggestions are informational, not a warranty. AutoSense AI does not replace a qualified mechanic's professional judgement. Always have safety-critical repairs (brakes, steering, suspension, airbags, fuel systems) verified by a certified mechanic before driving.

No warranty on AI accuracy. Diagnostic outputs are provided "as is" and "as available". We do not warrant that any diagnosis is correct, complete, or current.

4. Workshops, parts, and on-demand mechanics

paksaf.com connects you with independent workshops, parts suppliers, and mechanics. These are independent third parties, not employees of Mark Solutions. We verify workshop / mechanic identity (CNIC + business registration + on-site visit) before listing, but:

• Pricing, parts quality, repair quality, and warranty are the responsibility of the workshop / supplier.
• We facilitate the introduction, the booking, and (optionally) escrow payment — but we are not party to your contract with the workshop.
• Disputes between you and a workshop should first be raised with the workshop directly, then escalated to interact@paksaf.com.

5. Escrow payments

Where you choose escrow payment, funds are held by our regulated banking partner (Bank Alfalah in Pakistan; equivalent partners in other markets — see Privacy Policy §3) and released to the workshop only when:

• You mark the job as approved, or
• 72 hours have passed since the workshop marked the job complete and you have not raised a dispute, or
• A dispute is resolved in the workshop's favour.

Refunds, where due, are returned to your original payment method within 5 working days. Payment processing fees (typically 2.5%) are non-refundable.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law;
• Upload audio, photos, or content that infringes third-party rights or contains personal data of others without consent;
• Attempt to reverse-engineer, scrape at volume, or interfere with the Service;
• Use the Service to misrepresent vehicle condition for fraudulent resale;
• Pose as a verified workshop or mechanic if you are not one.

7. Intellectual property

All software, designs, text, graphics, and AI models comprising the Service are owned by Mark Solutions or its licensors. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You retain ownership of content you upload, but grant us a worldwide, royalty-free licence to process it for the purposes of providing the Service.

8. Liability cap

To the maximum extent permitted by applicable law, Mark Solutions' total aggregate liability arising out of or in connection with the Service is limited to the greater of (a) the amounts you paid to us in the 12 months preceding the claim, or (b) PKR 50,000. We are not liable for indirect, consequential, special, or punitive damages, lost profits, or vehicle damage caused by third-party workshops or by your own failure to verify diagnostic suggestions with a qualified mechanic.

9. Indemnification

You agree to indemnify and hold harmless Mark Solutions, its directors, employees, and partners from any claims, damages, or expenses arising out of your misuse of the Service, your breach of these Terms, or your violation of any third-party rights.

10. Termination

You may close your account at any time via the in-app settings. We may suspend or terminate accounts for material breach of these Terms with reasonable notice (immediate notice for fraud, payment chargebacks, or harm to other users).

11. Changes

We may update these Terms from time to time. Material changes will be announced at least 14 days in advance via in-app notification and email. Continued use after the effective date constitutes acceptance.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute that cannot be resolved through good-faith negotiation will be submitted to the exclusive jurisdiction of the courts of Karachi, Pakistan. Users in the EU, UAE, Türkiye, Russia, or Spain retain any mandatory consumer rights under their local law.
